These terms apply when you browse or buy from posh-elements.com, which is operated by Posh Elements Boutique. By placing an order you agree to them. Please read them alongside our Shipping Policy, Refund & Return Policy, Payment Policy and Privacy Policy, which form part of these terms.

Using this website

You may use this site to browse our range and to buy for your own personal use. You agree not to use it for anything unlawful, not to attempt to interfere with how it works, and not to copy or resell its content or our product photography without our written permission.

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order.

Account registration

You do not need an account to order, but if you create one you are responsible for keeping your password confidential and for activity that happens under your account. Tell us promptly if you think someone else has used it. We may suspend or close an account that is being used fraudulently or in breach of these terms.

Products, descriptions and images

We describe our products as accurately as we can, including fabric, fit and any feature we think you should know about. Photographs are taken to represent the item honestly, but colours can appear differently between screens and small variations are normal in garments produced in short runs.

All items are subject to availability. Because we buy in small quantities, a piece can sell out while it is in your basket.

Prices

All prices are in United States dollars (USD) and are shown on each product page. Prices exclude shipping, which is calculated and shown at checkout, and exclude any sales tax that may be applied at checkout.

We may change prices at any time, but a change will never affect an order you have already placed and paid for.

How a contract is formed

When you place an order you are making an offer to buy. We send an automatic email confirming that we have received it, which is an acknowledgement rather than an acceptance. The contract between us is formed when we email you to confirm that your order has been dispatched.

We may decline an order, and will refund any payment in full, if the item is out of stock, if there was a genuine error in the price or description, if we cannot verify your payment or delivery details, or if we reasonably suspect fraud. If we decline your order we will tell you why.

Payment

Payment is taken when the order is placed. The methods we accept and how card details are handled are set out in our Payment Policy and on our Secure Checkout page.

Delivery

We ship within the United States only. Processing and delivery estimates, shipping costs and what happens if a parcel goes astray are all set out in our Shipping Policy. Delivery estimates are estimates given to us by the carrier and are not guaranteed dates.

Risk in the goods passes to you when they are delivered to the address you gave us.

Returns and refunds

Your right to return an item, the condition it must be in and how refunds are issued are set out in full in our Refund & Return Policy. Nothing in these terms limits any right you have under applicable consumer protection law.

Reviews and content you submit

If you leave a review, please keep it about the product and keep it civil. We may decline to publish or may remove content that is abusive, misleading, unlawful or unrelated to the item. By submitting a review you give us permission to display it on the product page.

Intellectual property

The Posh Elements Boutique name, the content of this site and our product photography belong to us or to our suppliers and are protected by copyright and trade mark law. You may not reproduce them commercially without our permission.

Our responsibility to you

We take care to keep this site accurate and available, but we do not promise that it will be uninterrupted or free of errors. To the fullest extent permitted by law, our total liability arising out of an order is limited to the amount you paid for that order. Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, carrier disruption or supplier failure. If such an event affects your order we will contact you, and you may cancel for a full refund if the delay is substantial.

Changes to these terms

We may update these terms from time to time. The version that applies to your order is the version published on this page at the time you placed it. The date at the top of this page shows when it was last changed.

Governing law

These terms are governed by the laws of the State of Ohio and the United States. Any dispute will be dealt with by the courts of the State of Ohio, and this does not remove any protection available to you under the consumer law of the state in which you live.
